Brexit as a lever for further Tory attacks on our rights

A KUWG member has asked me to publish the below as a blog post after I had e-mailed it to him as an update on the Green Party's response to Labour's 2008 'welfare reform green paper'.
 
I suspect that the Tories are seeing Brexit as an opportunity to further attack disabled and other people's rights by rewriting our laws. The Chinese 'guolaosi' would think differently, no doubt. As Johann Hari reported in the Independent in 2010:
"Deaths from overwork are so common in Chinese factories that they have a word for it: guolaosi. China Daily estimates that 600,000 people are killed this way every year, mostly making goods for us. Li had never experienced any health problems, his family says, until he started this work schedule; Foxconn say he died of asthma and his death had nothing to do with them. The night Li died, yet another Foxconn worker committed suicide – the tenth this year."

It fits in with Naomi Klein's concept of 'disaster capitalism' as turning catastrophes into opportunities for more of Milton Friedman's
"holy trinity" -- privatization, deregulation and cuts to social spending -- in which governments dismantle trade barriers, abandon public ownership, reduce taxes, eliminate the minimum wage, cut health and welfare spending, and privatize education. She calls the means of achieving this goal "disaster capitalism" and describes how it has resulted in a worldwide redistribution of income and wealth to the already rich at the expense of economic solvency for the middle and lower classes.
As was merely touched upon in Writing off Workfare by Anne Gray and myself in 2008, UK 'welfare reforms' since the time Peter Lilley was the responsible government minister/secretary of state have been strongly influenced by dodgy American health insurance giant Unum who regard the UK as a 'potential market'. One line in 92 page DWP 'consultation paper' proposes imposing 'mandatory' activity on all ESA claimants

(How about that for a lack of transparency?)

The Department for Work and Pensions is considering forcing all sick and disabled people on out-of-work disability benefits to take part in “mandatory” activity, its new green paper has revealed.
The suggestion of compulsory activity is revealed in a single line of the 92-page work, health and disability green paper, published this week....

This Green Paper 'consultation' closes at 11:45pm on 17 February 2017. The next Green Party of England & Wales Conference is not scheduled till March-April 2017.

Meanwhile, what is mental health charity Mind doing in bed with DWP?

And what have coroners said about claimant deaths?

Perhaps there could even be scope for 'Progressive Allaince' responses?

Crapita suspends PIP assessor and other stories published 4 August 2016

Comrades will appreciate hearing that this story of a hateful disability benefits entitlement assessor getting some sort of 'come-uppance':

Incidentally, this instance is not the first time that a disability-benefits-eligibility assessor has been outed for hateful views by way of their Facebook content. 

I am also pleased to report that my finding a May 2016 press release on Sunday by way of a Google search for the American 'health insurance' company Unum helped source another new Disability News story:
The contacts to whom I fed that story by email were Mo Stewart, Prof. Peter Beresford, and Disability News Service's sole reporter John Pring.

The latter Google search stemmed out of an extension of the Internet search rankings experiment outlined in the blog post

Followers of the excellent Disability News Service may have noted that the publication date for many of their news items falls on a Thursday.(1)

The slippery slope to satirising standards regulators

Satirical songwriter Tom Lehrer famously took the awarding of a Peace Prize to Henry Kissinger as his cue for retirement from writing satirical songs. He said that that choice of Nobel Peace Prize winner betokened the death of satire, as satire had become reality.

Tom Paxton who had recognised Lehrer as a model in his own path toward writing satirical songs took that Peace Prize award for Kissinger as his cue to write a hard-hitting song about just some of Kissinger's 'accomplishments' in a song called The White Bones of Allende.(1)

I was reminded of that Tom Lehrer story by my discovery over the weekend of who the current Conservative Government had chosen to operate as commissioners of the Care Quality Commission that is supposed to help regulate services dedicated to the well-being of vulnerable people in care homes, etc.

A big difference between the awarding of a Nobel Peace Prize for 'Dr K' and the Conservative Government's choice of Care Quality Commissioners has been the level of publicity given to those two events. I would argue that my discovery via the Disability News Service website of the fact that the Care Quality Commission has in effect been privatised serves to emphasise for me the enormous need for the Disability News Service in publicising what we the public would otherwise be largely ignorant of.

I already knew from discussion at a Kilburn Unemployed Workers Group meeting that the current Conservative Government had sold the previously State-owned Remploy to Maximus, the company that took over from Atos Healthcare in administering Work Capability Assessments for the Department for Work & Pensions. Could disability benefit claimants sue Serco or Hewlett-Packard Enterprise over software screw-up?

Disability News Service reports that appallingly software is causing problems for disability benefit claimants, and that the blame belongs to the private sector contractor involved.

'Appallingly bad' software may cause lost PIP (Personal Independence Payment) letters, says whistleblower(1)

Vital letters that tell disabled people they have to transfer to the government’s new disability benefit are being lost in the system, leading to them losing financial support for months on end, according to a whistleblower.Rebecca*, who has asked to remain anonymous, works for Serco, the company paid by the Department for Work and Pensions (DWP) to run the helpline that deals with all new claims for personal independence payment (PIP).Rebecca has told Disability News Service (DNS) that she believes the missing letters are probably the result of the “appallingly bad” PIP CS software designed for DWP by another private sector outsourcing giant, Hewlett Packard Enterprise (motto: Tomorrow Belongs to the Fast)
Meanwhile, there are loads of 'ambulance chasing' law firms advertising their wares on TV over the PPI (Payment Protection Insurance) fiasco, asserting that banks have set aside millions of pounds to deal with the fallout of that fiasco. And though the TV-advertised ambulance chasing law firms dealing with medical negligence cases say nothing about how much the government has set aside for dealing with medical negligence cases, the Telegraph has revealed that the government has set aside 1/4 of the NHS budget for that fiasco.(2) (How is that for government investment in career development?)

So how about claimants affected by this screw-up suing those involved?

Dying for DWP recognition as 'genuine' claimants?

Many people whose benefits have been stopped have serious health conditions, so of course more are dying, admits DWP

Yet again Department for Work and Pensions (DWP) has blocked the publication of statistics showing how many people have died within six weeks of having their benefits stopped.
These figures were routinely published until 2012, when this government’s Welfare Reform Act  started to bite. Since then the DWP has steadfastly refused to publish new statistics, saying:

  2. That so many people requested the figures that the requests themselves were ‘vexatious’ and could therefore be ignored. 
Direct requests to the DWP from several MPs have had no more luck.

Now the Information Commissioner’s Office (ICO), an independent authority set up to uphold public information rights, has agreed that there is no reason not to publish the figures. And yet again the DWP is trying to wriggle out.

What struck me most in this article from the Huffington Post was this warning from the DWP:
“The DWP  warned it was irresponsible to suggest a causal link between the death of an individual and their benefit claim, and that mortality rates among people with serious health conditions are likely to be higher than those among the general population.”(1)

Well, The system of disability assessments was supposed to sort out who needs disability benefits. The DWP’s warning demonstrates that they don’t see people with serious health conditions who are more likely to die as being in need of benefits. And if they are being kicked off their benefits and then dying, that’s just fine as long as the Tories can dodge publishing the figures..

The DWP takes its orders from the Conservative Government. And David Cameron and his ministers appear to be completely at ease with the idea of stripping seriously ill people of their benefits and them subsequently dying. If those people die, well, they were more likely to die anyway.

I read over and over again in comments here and elsewhere on the net of people who have been thrown off disability benefits as ‘fit to work’, but cannot then get unemployment benefits because the Job Centre deems them ‘Unfit to work’. I’m personally trying to help 2 people in this exact situation right now. As a result of losing their sickness benefits and having no income, both have been hit by a spiral of depression which made it impossible to appeal against the decision in the one month time slot allowed by the DWP.

More than 18,000 people have signed a Change.org petition in under a week after the DWP appealed a decision to release the sensitive figures

I can’t leave this topic without mentioning the tireless campaigning to get these figures published.over several years by John Pring of the Disability News Service.(3) If the government is pushed into a corner it can’t wriggle out of and forced to release these figures, it will largely be thanks to John.

The Green Party has requested that Iain Duncan Smith, Secetary of State for Work and Pensions, issue a formal apology for misleading the public after  he denied knowledge of the number of benefit claimant deaths shown to be caused by suicide.

Contrary to Mr Smith's statement, issued whilst taking part in a BBC Daily Politics debate on Welfare, research by the Disability News Service (DNS) has found that the Department for Work and Pensions has withheld research showing that over 40 benfit claimant deaths since 2012 have been linked to suicide.(3)

Spoon-fed reporting distorts democracy

Under-staffed news desks lead to superficial repackaging of Government or corporatist press-releases, leading to improperly informed voting
Watching BBC Breakfast recently I have been horrified at the lack of depth given to reporting matters important to KUWG. On not one of their news reports regarding the current General Election have I come across an item of great relevance to disabled people and their carers regarding that voting occasion in the murky gloom of skeletal plans to cut a further £12bn from the Department for Work & Pensions budget — horrific though that prospect is in itself.

Reports of the scrapping of UK involvement in the Human Rights Act does appear on the BBC website's review of the Conservative Manifesto, but only apparently in the smear story spinning terms offered by Tory HQ.(1) My late LLB (Hons) friend and McKenzie Friend for Work Capability Assessment retests Anne McArthur did warn me of Tory plans to repeal the Human Rights Act and the erosion of human rights for disabled people.(2) She also affirmed that UK involvement in the EU had been instrumental in the creation of, say, the Disability Discrimination Act (1995).

Though Anne died in October 2014 it is great that we have John Pring's Disability News Service to continue reporting on what would otherwise be reported without reference to the relevance to disabled people.(3)

The Conservative party has made it clear in its election manifesto that it plans to make further sweeping cuts to social security spending, and scrap the Human Rights Act.
The manifesto says that the party’s approach on the economy is “focused on reducing wasteful spending, making savings in welfare, and continuing to crack down on tax evasion and aggressive avoidance.”
The party would cut social security spending by a further £12 billion a year, but has yet to say how it will find most of these “savings”.(4)

  2. a major irritant to the bullying decision-makers and only-following-orders Civil disServants who would rather such people and their potential allies — including, of course, the electorate in a General Election where a further £12bn cuts is being outlined but not really discussed — were left uninformed and therefore less able to mobilise against such cuts.
I shall leave this blog piece here for now, while pointing out that it is important to see beyond the 'spin' of the messenger. Also realise that there is a major difference between spoon-fed reporting and proper investigative journalism.
